There is a dispute between certain owners of Rockville MD real estate and the Montgomery County Parks and Planning staff.  Certain  Montgomery County real estate owners in the White Flint area, would like the new MARC station to be positioned  on there property rather than the spot selected by the Parks and Planning Staff.  The group of property owners, from Nicholas Court also stated that they have set aside a specific amount of property for the station.  If they were to decide on using Nicholas Court, it would allow existing neighborhoods such as Randolph Hills located across the tracks, to be more accessible to the station.  One of their arguments is they may not be able to acquire the site that the parks and planning staff is currently favoring.  The land that this group of Montgomery County MD real estate owners has already set aside located next to a potential Rockville Maryland real estate development.  

The property that the Parks and Planning staff would like to use off of Nebel Street near Montrose Road is owned by the Montouri family Trust.  Even though the Parks and Planning staff prefer this location due to its closer proximity to the White Flint Metro Station, the Montouri Family Trust currently intends to fight the development of the MARC Station on their land.  One reason they are disputing the MARC station development on their land, is they believe it to be redundant due to its proximity to white flint metro.  The site is roughly 2 acres large, and even though there is nothing planned for this plot of land currently, in the future it could be used for residential projects, and they believe with the MARC station also being located on this land would make it much harder for the development of the land.  

Even with all the opposition that the Parks and Planning is having with there site selection, they currently still support using the Montouri property.  The reason for this is that it is located in a better location for commuters that need to use the Metro station. Another reason they stand behind using the Montouri site deals with zoning issues. Currently the Montouri property zoning would accommodate the needs of a MARC station,  and if Nicholas court was to become home of the MARC station they would need to increase the building sizes that  can be constructed on that parcel of land.
